Since the
1950’s, a variety of photoelectric devices
have been used to obtain blood-alcohol readings from breath samples. Although
good readings can be obtained from a qualified, cautious and
prudent operator, the readings are subject to
interpretation. Variables exist that offer a source of
inaccuracy. Operator experience plays a vital factor in
determining the suitability of breath samples. Case law
has been built on the foundation if this now more than 50-year old
technology.
